Councillor Cathy Glynn Davies declared that family members owned an establishment in Rowlands Road which also held an off sale of alcohol licence.  She stated that she had no financial interest in that business and was in no way pre-determined in this case.

Exclusion of the press and public

After taking advice from the Legal Officer the Chair decided that due to certain restricted information within the representations accompanying the report it would be favourable to exclude the press and public from this point in the meeting. After taking a vote in favour of this proposal it was resolved that under Section 100A(4) of the Local Government Act 1972, the public and press be excluded from the meeting from the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in the paragraph of Part 1 of Schedule 12A to the Act indicated against the item.

Before the Sub-Committee was a report by the Director for Communities, which has been circulated to all Members, a copy of which is attached to the signed copy of these minutes as item 4. Members were requested to consider and determine an application for a new premises licence for Ideal Supermarket, Rowlands Road, Worthing.

 

Presenting Officer outlined the application

 

The Licensing Officer presented the report explaining the details of this application.

 

The Committee carried out the procedure laid before it.

 

The meeting adjourned at 7:30pm for the members to consider their decision.

 

In reaching its decision the Licensing Sub-Committee has given due regard to the following:

 

·         The statutory licensing objectives

·         Worthing Borough Councils Statement of Licensing Policy

·         Guidance under section 182 by the Home Secretary and Licensing Act 2003.

·         The application, written/oral representations made at the hearing and in writing.

·         The Committee also gave regard to human rights legislation and the rules of natural justice.

 

In discharging its functions the Committee did so with a view to promoting the Licensing objectives, the relevant objectives here were Prevention of Crime and Disorder, Prevention of Public Nuisance and Public Safety.   

 

Resolved: To not grant a licence

 

The reason for the decision is: The reasons for this decision are exempt.
