Exclusion of the Press and Public

In the opinion of the proper officer the press and public should be excluded from the meeting for consideration of item 3. Therefore the meeting is asked to consider passing the following resolution: ‘that under section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting from the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in the paragraph of Part 1 of Schedule 12A to the Act indicated against the item.’

Local Government (Miscellaneous Provisions) Act 1976 Review of Hackney Carriage Driver’s Licence

To consider a report by the Director for Communities, copy attached as item 3.

Minutes:

Before the Committee was a report by the Director for Communities, a copy of which had been circulated to all members.  Members were requested to consider and determine a review of a Hackney Carriage Driver Licence.

 

The Committee carried out the procedure laid before it.

 

The meeting adjourned at 7:23pm for the members to consider their decision and reconvened at 7.51pm.

 

In reaching its decision, the Licensing Committee gave due regard to relevant legislation and guidance within the Councils Hackney Carriage and Private Hire Licensing Handbook. The Committee also gave regard to human rights legislation and the rules of natural justice.

 

Resolved

The Committee has taken the following decision to: provide a formal warning to remain on the respondent’s licence file for 4 years.

 

Reasons for decision

The reasons given for the decision are that the committee members are extremely concerned that there have been 17 incidents within the last 6 years that the driver has held a hackney driving licence including vehicle safety, motoring offences, non- compliance with Worthing Borough Council hackney and private hire driving conditions and customer complaints. This behaviour is not acceptable from a professional driver who is in a position of trust. Should any further incidents occur officers will be expected to refer this matter back to the licencing committee and everything will be taken into account. This is the driver’s final chance to improve his behaviour or he will risk losing his licence.
