Exclusion of the Press and Public

In the opinion of the proper officer the press and public should be excluded from the meeting for consideration of items 3 & 4. Therefore the meeting is asked to consider passing the following resolution:

 

‘that under section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting from the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in the paragraph of Part 1 of Schedule 12A to the Act indicated against the item.’

Local Government (Miscellaneous Provisions) Act 1976 Determination of a New Private Hire Driver Licence application

To consider a report by the Director for Communities, copy attached as item 3

Minutes:

LRSC/017/22-23         Local Government (Miscellaneous Provisions) Act 1976 Determination of a New Private Hire Driver’s Licence application

 

Before the Sub-Committee was a report by the Director for Communities, a copy of which had been circulated to all Members, a copy of which is attached to the signed copy of these minutes as item 3.

 

The Committee carried out the procedure before it.

 

The committee adjourned at 7.31 pm to deliberate and make a decision and reconvened at 7.51 pm to announce the decision.

 

Decision:  To grant the Private Hire Driver Licence

 

The reason for the decision is:

 

The Committee has listened carefully to the evidence before them.  They accept that the applicant lost his driving licence in 2020 and therefore has remained conviction free for 3 years.  They are concerned to have learnt that there was a further speeding conviction in 2018 and then these four offences in 2020.  If there are any further incidents the Committee expects this matter to come back before them to determine the licence.  The Committee expects that a full driving application is made and that a speed awareness course is also completed as a condition of licence.

Local Government (Miscellaneous Provisions) Act 1976 Determination of a Private Hire Driver Licence application

Before the Sub-Committee was a report by the Director for Communities, a copy of which had been circulated to all Members, a copy of which is attached to the signed copy of these minutes as item 4.

 

The Committee carried out the procedure before it.

 

The committee adjourned at 8.10 pm to deliberate and make a decision and reconvened at 8.36 pm to announce the decision.

 

Decision:  To grant the Private Hire Driver Licence

 

The reason for the decision is:

 

The Committee are concerned about granting the applicant a licence.  However they have considered the Adur Hackney and Private Hire Vehicle Handbook and that he has been punished for those previous misdemeanours by having his licence revoked for 22 months.  It is expected that he will conduct himself as a fit and proper person in the future and there must be no further incidents.  Any complaints that he receives as a Private Hire Driver must be passed on to the Licensing office within 7 days of receiving them.
