Before the Sub-Committee was a report by the Director for Sustainability & Resources, which has been circulated to all Members, a copy of which is attached to the signed copy of these minutes as item 4. Members were requested to consider and determine an application from Mr Mr Aydin Unat for Aydo - International Supermarkets.

 

Presenting Officer outlined the application

 

The Licensing Officer outlined the application explaining that, following successful mediation, Sussex Police had withdrawn their objections but that 2 written representations from members of the public had not been withdrawn and needed to be considered. Neither of these representors were able to attend in person.

 

The applicant confirmed that the Licensing Officer had provided an accurate outline of the application.

Representation from the Applicant

 

The applicant’s representative gave a presentation giving the Committee members background information of Aydo and how they intended to operate within the premises.

 

Questions from Members to the Applicant

 

In response to members' questions the applicants explained that they were applying for this licence so that they may remain competitive with other businesses in the area.

 

The meeting adjourned to go into closed session at 6.51 pm and reconvened at 7.02 pm

 

In reaching its decision the Licensing Sub-Committee has given due regard to the following:

 

·         The statutory licensing objectives

·         Worthing Borough Councils Statement of Licensing Policy

·         Guidance under section 182 by the Home Secretary and Licensing Act 2003.

·         The application, written/oral representations made at the hearing and in writing.

·         The Committee also gave regard to human rights legislation and the rules of natural justice.

 

In discharging its functions the Committee did so with a view to promoting the Licensing objectives, the relevant objectives here were Prevention of Crime and Disorder, Public Safety, Prevention of Public Nuisance and Protection of Children for Harm.     

 

Resolved: Grant the premise licence

 

The reason for the decision is: The Committee considered carefully the evidence before them.  Following successful mediation with the Applicant Sussex Police have subsequently withdrawn their representation.  The Committee considered the representations that had been made by two members of the public however with the operating schedule and the conditions agreed with Sussex Police they believe that the licensing objectives will not be undermined.  The public are reminded that if the licensing objectives were undermined the licence would be subject to a review. 

 

Advice to parties: 

 

The Applicant and those who have made representations in connection with this application are reminded that they may appeal against this decision to the Magistrates Court within 21 days of receiving the notice.

 

The Responsible Authorities and any other Interested parties are reminded that they may apply for a review of this licence “after a reasonable interval” pursuant to Section 51 of the Licensing Act. 

 

Any licence granted under the Licencing Act 2003 does not override any planning restrictions on the premises nor any restrictions that may be attached to the lease of these premises.

Before the Sub-Committee was a report by the Director for Sustainability & Resources, which has been circulated to all Members, a copy of which is attached to the signed copy of these minutes as item 5. Members were requested to consider and determine an application from Mr Danny Giles & Mr Robert Watson regarding their premises, Spun.

 

Presenting Officer outlined the application

 

The Licensing Officer presented the report explaining that the application had been the subject of formal representation by 8 members of the public but no representations from responsible authorities. He clarified that at present he had no information regarding any mediation but explained that the letter within the addendum was from the applicants to the residents who had made formal representation, attempting to alleviate their concerns regarding noise nuisance.  

 

The applicant confirmed that the Licensing Officer had provided an accurate outline of the application.

The speaker made a representation regarding his concerns pertaining to noise nuisance.

In response to Members’ questions the speaker confirmed that the noise nuisance was less in the winter months whilst the doors were closed.

 

Questions from the Applicant to the representor

 

In response to the applicant's questions the speaker confirmed that he had not complained before this time because the premises had been quieter this past autumn. However, with the possible increase of hours his concerns regarding noise nuisance had escalated.

The speaker made a representation regarding his concerns pertaining to noise nuisance.

The speaker made a representation regarding her concerns pertaining to noise nuisance.

In response to the Members’ questions the speaker confirmed that she had witnessed some antisocial behaviour in the area during some evenings, but as far as she was aware this did not emanate from Spun.

The Chair of Worthing Pub Watch confirmed that, as he had met with the applicant who had agreed to become an active member of Pub Watch, he had mediated and withdrawn any objections.
