Licensing Act 2003 – Application for a new Premises Licence. To consider a report by the Director for Sustainability & Resources, copy attached as item 4. Additional documents:
Minutes: Before the Sub-Committee was a report by the Director for Sustainability & Resources, which has been circulated to all Members, a copy of which is attached to the signed copy of these minutes as item 3. Members were requested to consider and determine an application from Express Pizza & Chicken.
Presenting Officer outlined the application
The Licensing Officer outlined the application explaining that the police had withdrawn their representation following successful mediation with the applicant.
The applicant confirmed that the Licensing Officer had provided an accurate outline of the application.
Questions from Members for the presenting Officer
· Is the area in front of the premises private property or part of the public highway/pavement? There is a small section of tarmac between the premises and the public highway/pavement which belongs to the property.
Representation from the representor - Environmental Health Officer
The Officer raised concerns regarding - · Noise nuisance, particularly at night generated by members of the public and delivery vehicles idling. · Parking concerns as there is a pedestrian crossing in front of the premises and double yellow lines on the roads.

· Does the car park at the rear of the premises back onto residential properties? The property next to the passageway leading down to the carpark has residential properties on the upper levels. On the map there are areas of green adjacent to the carpark so these may be the gardens of residential properties.
Questions from the Applicant to the representor - Environmental Health Officer
· What is your concern regarding parking as we have some parking at the rear and parking is permitted in Heene Road near our premises? We are concerned that parking inappropriately whilst visiting the premises may be a problem.
Representation from the Applicant
The applicant gave a representation explaining - · They were a small business built from scratch · They had taken all the concerns of the representors into account · They have security on the premises in the form of CCTV and security personnel.
Questions from Members to the Applicant
· What level of business do you expect to have between 23.00 and 05.00? It is hard to say but we would expect to see more delivery vehicles than members of the public during those hours. · Are you aware that if we granted you the licence this evening, the planning permissions you currently have are until midnight. Until you obtain planning permission for 23.00 - 05.00 you will be unable to operate in those hours? Yes, we are aware. We have not applied for planning permission yet. · The licence application form has a section for you to demonstrate how you plan to meet the licensing objectives but this has not been completed. We filled in the application form ourselves, consulted the Licensing Officer and took his advice. We will meet the licensing objectives and we have measures such as CCTV and security personnel to achieve that. · How many parking spaces do you have at the rear of the property? |
