Exclusion of the Press and Public

In the opinion of the proper officer the press and public should be excluded from

the meeting for consideration of item 3. Therefore the meeting is asked to

consider passing the following resolution:

 

‘that under section 100A(4) of the Local Government Act 1972, the press and

public be excluded from the meeting from the following items of business on the

grounds that they involve the likely disclosure of exempt information as defined in

the paragraph of Part 1 of Schedule 12A to the Act indicated against the item.’

Licensing Act 2003 – Licensing Act 2003 – Application for the Review of a Premises Licence under Section 51

To consider a report by the Director for Sustainability & Resources, copy attached as item 3.

Before the Sub-Committee was a report by the Director for Sustainability & Resources, which has been circulated to all Members, a copy of which is attached to the signed copy of these minutes as item 3. Members were requested to consider and determine an application for a Licence Review from Trading Standards.

 

The meeting was adjourned on 30 September 2024 and reconvened on 5 November 2024 due to availability of the required translator.

 

In reaching its decision the Licensing Sub-Committee had given due regard to the following:

 

? The statutory licensing objectives

? Worthing Borough Council’s Statement of Licensing Policy

? Guidance under section 182 by the Home Secretary and Licensing Act 2003.

? The application, written/oral representations made at the hearing and in

writing.

? The Committee also gave regard to human rights legislation and the rules of

natural justice.

 

In discharging its functions, the Committee did so with a view to promoting the

licensing objectives, the relevant objectives here were prevention of crime and

disorder and protection of children from harm.

 

The decision is exempt.
