Local Government (Miscellaneous Provisions) Act 1982 – Schedule 4 Changes to Street Trading Controls pdf icon PDF 2 MB

Minutes:

Before the Committee was a report by the Director for Communities, a copy of which had been circulated to all members. A copy of which is attached to the signed copy of these minutes as item 4.

 

At a meeting on the 28 June 2021 Members authorised officers to publish a notice of intention to pass a resolution changing the designation of three streets from prohibited to consent for the purpose of street trading. Those streets were Broadwater Street West, South Street and Liverpool Terrace and Gardens. Following consultation objections had been received in respect of Liverpool Terrace and Gardens. Members were invited to consider the representations received and further consider the change of consent for the streets in question.

 

The Senior Licensing Officer was at the meeting to present the report and answer questions. Members questioned the Officer on a number of issues ranging from the process for designating the streets, the nature of the streets under consideration and the type / frequency of events that could take place.

 

A Resident who had made a representation relating to Liverpool Terrace was invited to make an oral submission which is summarised as follows:

 

·       Liverpool Terrace was a residential cul-de-sac;

·       The gardens were small;

·       The gardens were currently used by people to eat food purchased from nearby restaurants;

·       The gardens were a small wildlife refuge in the middle of Worthing, home to a diverse group of birds;

·       There was no pavement around the park and people leaving the park would do so by exiting directly onto a road;

·       The area was an important area to sit, eat and relax.

 

Members debated the proposals before them and agreed that Liverpool Terrace was not an appropriate place for a consent street as it was an essential green space and that there were better options for consent streets within the town centre. It was agreed that Broadwater Street West and South Street were appropriate locations and that the consent should be confirmed in those locations

 

Resolved:

 

i)               That the consent for the streets Broadwater West (South of Ardsheal Road) and South Street be confirmed for the purposes of street trading in accordance with the provisions of the Local Government (Miscellaneous Provisions) Act 1982. Such resolution to come into effect on 8 November 2021;

ii)              That the consent for Liverpool Terrace and Gardens be not confirmed and that it remain a prohibited Street
